1. Eligibility

The Program is currently available to eligible individuals who are legally resident in the United States, Canada or Australia, have reached the age of majority applicable in their place of residence, and have the legal capacity to enter into this Agreement. Beyond Homelands may request reasonable information to verify eligibility.

2. Independent Relationship

The parties intend the Partner to participate as an independent contractor and independent referral partner. Nothing in these Terms is intended to create an employment relationship, agency, partnership, joint venture, franchise or other representative relationship.

The Partner is not an employee of Beyond Homelands and is not entitled to salary, wages, employee benefits or reimbursement of expenses unless expressly agreed in writing. The Partner independently decides how, when and where to conduct lawful promotional activity and is responsible for the Partner's own equipment, expenses and business organization.

The legal characterization of a working relationship depends on applicable law and the actual facts of the relationship, not only on contractual labels.

3. No Authority to Bind Beyond Homelands

The Partner has no authority to bind Beyond Homelands, enter into contracts on its behalf, collect payments for it, make legal commitments or warranties on its behalf, or otherwise legally represent Beyond Homelands.

The Partner may not modify product prices, customer discounts, terms of sale, return policies, shipping conditions or other commercial conditions established by Beyond Homelands or its commerce platform.

4. Non-Exclusivity

Participation is non-exclusive. The Partner may engage in other lawful employment, business, affiliate or promotional activity, subject to these Terms and to the Partner's obligations concerning Beyond Homelands intellectual property, confidential information and applicable law.

5. Referral Code and Customer Discount

Each active Partner receives a unique referral code. Under the current Program configuration, a Qualified Purchase using that code receives a 7% customer discount on the eligible product amount. Shipping, taxes and other charges are excluded unless Beyond Homelands expressly states otherwise.

Referral codes may not be sold, transferred, altered or used in a deceptive, fraudulent or misleading manner.

6. Partner Commission

The Partner's sole compensation under the Program is the commission expressly provided under these Terms for Qualified Sales attributed to the Partner. The current commission rate is 20% of the eligible listed product value attributed to the Partner's referral code.

Shipping, taxes, fees, cancelled orders, refunded amounts and other non-eligible charges are excluded. Beyond Homelands may correct attribution or commission calculations where reasonably necessary to reflect cancellations, refunds, duplicate events, fraud, abuse or technical errors.

7. Monthly Activity Requirement

Beginning with the Partner's first full calendar month after activation, the Partner is expected to generate at least one Qualified Sale per full calendar month to keep the referral code active.

The activation month is never counted. A completed month is reviewed only after the Program's review period. Under the current operational schedule, the monthly review occurs on or after the 26th day of the following month.

Where a Partner does not meet the monthly requirement, Beyond Homelands may place the referral code into a review queue. Beyond Homelands may, in its sole discretion, grant a temporary grace period or other exception without creating any entitlement to future exceptions or waiving any Program rule.

8. Payouts

Partner commissions are currently paid in U.S. dollars through PayPal. There is currently no minimum payout threshold. The Partner must provide and maintain a valid PayPal email address and is responsible for ensuring that the payout information is accurate.

Beyond Homelands never requests the Partner's PayPal password. Commissions remain subject to order verification, cancellation and refund review, fraud checks and other Program rules before becoming payable.

9. Advertising Disclosure and Consumer Protection

Whenever publicly promoting Beyond Homelands, the Partner must clearly and conspicuously disclose the Partner's financial relationship with Beyond Homelands and the fact that the Partner may receive a commission from qualifying purchases.

The Partner must comply with all advertising, endorsement, influencer marketing, consumer-protection and disclosure requirements applicable in the Partner's jurisdiction and in any jurisdiction reasonably targeted by the Partner's promotional content.

Promotional statements must be truthful and not misleading. The Partner must not make unsubstantiated product claims, misrepresent prices, delivery terms, product characteristics or Program benefits, or imply that the Partner is an employee, agent or legal representative of Beyond Homelands.

10. Taxes and Local Compliance

The Partner is responsible for reporting and paying taxes, duties, social contributions or other charges arising from commissions received under the Program, and for obtaining any registration, business number, permit or authorization required under laws applicable to the Partner.

The Partner must provide reasonable tax or compliance information requested by Beyond Homelands where required by applicable law.

11. Intellectual Property and Brand Use

Participation does not transfer ownership of any Beyond Homelands trademark, copyright, design, domain name or other intellectual property. The Partner may use approved brand materials only for lawful promotion of the Program and must stop using them when participation ends.

The Partner may not register domains, social handles, advertising accounts or other identifiers that impersonate Beyond Homelands or create a false impression of official ownership or representation.

12. Prohibited Conduct

The Partner may not engage in fraud, self-dealing designed primarily to generate commissions, deceptive advertising, spam, unlawful messaging, unauthorized paid-search impersonation, misuse of customer information, manipulation of referral attribution, or any conduct reasonably likely to harm customers, the Beyond Homelands brand or the integrity of the Program.

13. Suspension and Termination

Beyond Homelands may suspend or terminate a Partner account or referral code for material breach of these Terms, fraud, deceptive promotion, misuse of intellectual property, abuse of referral codes, failure to meet Program eligibility requirements, or other conduct reasonably harmful to Beyond Homelands, customers or the integrity of the Program.

Accrued commissions remain subject to the applicable order, refund, fraud and eligibility rules.

14. Program Changes

Beyond Homelands may reasonably update Program mechanics, commission rates, discount rules, eligible territories or operational procedures. Material changes will apply prospectively and may require acceptance of updated Terms.

15. Governing Law and Jurisdiction

These Terms and any non-contractual obligations arising out of or in connection with the Partner Program are governed by the laws of Italy.

To the fullest extent permitted by mandatory applicable law, any dispute arising out of or relating to the Partner Program or these Terms shall be subject to the exclusive jurisdiction of the courts of Milan, Italy. Nothing in this clause excludes any jurisdiction, protection or right that cannot lawfully be waived under applicable mandatory law.

16. Specific Approval of Certain Clauses

Where Articles 1341 and 1342 of the Italian Civil Code apply, the Partner specifically approves the provisions concerning the monthly activity rule and discretionary grace periods (Section 7), commission adjustments (Section 6), suspension and termination (Section 13), Program changes (Section 14), and governing law and exclusive jurisdiction of the courts of Milan, Italy (Section 15).
